The South Africa Kashmir Action Group (SAKAG) and Muslim Lawyers Association (MLA) File crimes against humanity Complaint Against Visiting Indian Prime Minister Narendra Modi for investigation, arrest and prosecution under international customary law and Rome Statue. Johannesburg, South Africa — The South Africa Kashmir Action Group (SAKAG), led by its Chairman Salman Khan, in partnership with the Muslim Lawyers Association (MLA), has formally lodged a criminal complaint with the Commissioner of the South African Police Service (SAPS), the National Director of Public Prosecutions (NDPP), and the Directorate for Priority Crime Investigation (DPCI). The complaint calls for the investigation, arrest, and prosecution of the visiting Prime Minister of India, Narendra Modi, for alleged crimes against humanity and crimes against humanity committed in India-illegally Occupied Jammu and Kashmir (IIOJK). The case coincides with Mr. Modi’s visit to South Africa to attend the G20 Summit in Johannesburg.


Attorney Tayob said that Captain Matlhabe of SAPS has confirmed via email acknowledging the receipt of complaint documents and confirms that he will attend upon the National Prosecuting Authority to obtain directions to in regards to further investigation of the matter complaint. The complainants assert that grave breaches of international humanitarian law and serious violations of human rights have occurred in IIOJK under the authority and command of Mr. Modi’s government. These alleged acts contravene the Geneva Conventions, Universal Declaration of Human Rights (UDHR), International Covenant on Civil and Political Rights (ICCPR), and the Rome Statute of the International Criminal Court (ICC)—all of which South Africa has committed to uphold.


Legal Basis of the Complaint: The first complainant, the Muslim Lawyers Association (MLA)—a registered voluntary legal body and the second complainant, the South African Kashmir Action Group (SAKAG), bring this complaint:- Under International law applies under several sections of the South African Constitution, primarily Sections 231-233, which cover international agreements, customary international law, and the application of international law in interpreting domestic legislation. Additionally, Section 38(a)39(1)(b) mandates that courts must consider international law when interpreting the Bill of Rights. 

of the Constitution of the Republic of South Africa, 1996, acting in their own interest, and on behalf of victims in IIOJK who are unable to act in their own name;- In furtherance of their civil society mandates to uphold justice, human rights, and international accountability;- On the principle that war crimes and crimes against humanity constitute jus cogens violations—universally condemned and non-derogable norms under international law.

A Moral and Legal Obligation for South AfricaThe complainants underscore that war criminals are enemies of all humankind, and thus every responsible nation shares a duty to ensure accountability.“ It is unthinkable that a person accused of such heinous crimes could be welcomed in South Africa with immunity,” said Salman Khan, Chairman of SAKAG. “South Africa, born from the struggle against apartheid and oppression, carries both a moral and legal responsibility to stand with victims of state terror and uphold the rule of international law.” Failure to act, the complainants warn, risks turning South Africa into a safe haven for war criminals, undermining the country’s global standing and the principles enshrined in Chapter 2 of the South African Constitution—the Bill of Rights. This complaint thus appeals to South Africa’s responsibility to protect, its commitment to the rule of law, and its historic solidarity with oppressed peoples worldwide.

Muslim leadership have failed to acknowledge their colonial brutality over 700 years+. There was no truth and reconciliation like done in South Africa. Rather their politically lobbying in India resulted in these atrocities being swept under the carpet, under the pretext of empowering "social harmony", while 75 years later it is the same corrupt players that push the Kashmiri issue internationally but never mention the rights of the Kashmiri Pandits or the injustice that took place. Sad to see SA Mulsims support this, always assumed they where more liberal and educated. ps. Kashmir’s tragedy did not start in 2019 – or with Modi + are Muslims willing to give back the 40,000 temples in India that are illegally occupied? Lets…
